Is Karnan's determination as HC judge a reflection on collegium framework?



NEW DELHI: Is determination of supporter Chinnaswamy Swaminathan Karnan as a judge by the two-level collegium a miserable reflection on its capacity to chase ability for the legal? Would the National Judicial Appointments Commission (NJAC), which the Supreme Court suppressed as illegal, have been a superior procedure to choose judges to protected courts?

Equity Karnan's name figured among the 14 chosen in September 2008 by the Madras HC collegium involving then Chief Justice A K Ganguly and Justices P K Mishra and S J Mukhopadhaya. Judges Ganguly and Mukhopadhaya later progressed toward becoming SC judges while Justice Mishra resigned as Patna HC boss equity and was named as Goa Lokayukta a year ago.

The names achieved the then SC collegium comprising of then CJI K G Balakrishnan and Justices B N Agrawal and Arijit Pasayat. Before putting the names before the SC collegium, CJI Balakrishnan had looked for the perspectives of counseling judges — Justices Markandey Katju, V S Sirpurkar and P Sathasivam, every one of whom had a spell in Madras HC as boss equity or judge.
